Department of Labor & Dollar General Reach Safety Agreement to Enhance Workplace Conditions Nationwide

By

The U.S. Department of Labor has announced a comprehensive corporate-wide settlement with Dollar General and its retail subsidiaries. This agreement mandates significant safety improvements across all Dollar General stores, aiming to create safer environments for thousands of workers nationwide.

The settlement, facilitated by the Occupational Safety and Health Administration (OSHA), reflects a strong commitment to worker safety. "This agreement commits Dollar General to making worker safety a priority by implementing significant and systematic changes in its operations to improve accountability and compliance, and it gives Dollar General employees essential input on ensuring their own health and safety," said Douglas L. Parker, Assistant Secretary for Occupational Safety and Health. "These changes help give peace of mind to thousands of workers, knowing that they are not risking their safety in their workplaces and that they will come home healthy at the end of each day."

As part of the settlement, Dollar General has agreed to pay $12 million in penalties. More importantly, the company is required to implement sweeping changes to its safety practices. These changes include establishing and maintaining an expanded safety structure and a robust safety and health management system. This involves hiring additional safety managers to oversee compliance and ensure that safety protocols are followed meticulously.

Inventory Management and Training

One of the critical areas addressed by the settlement is inventory management. Dollar General has committed to significantly reducing its inventory and improving stocking efficiency. This measure aims to prevent blocked exits and unsafe material storage, which have been recurring issues in many of its stores. Proper inventory management is crucial to maintaining clear and safe pathways, especially in emergency situations.

Training is another cornerstone of the agreement. Dollar General will provide comprehensive safety and health training to both leadership and non-managerial employees. This training is designed to equip employees at all levels with the knowledge and skills needed to maintain a safe working environment. By fostering a culture of safety through education, Dollar General aims to empower its workforce to identify and address potential hazards proactively.

The settlement also emphasizes the importance of employee involvement in safety initiatives. Dollar General will develop a safety and health committee that encourages active employee participation. This committee will serve as a platform for employees to voice their concerns and contribute to safety policies. By involving employees in the decision-making process, Dollar General aims to enhance its safety culture and ensure that safety measures are both practical and effective.

Compliance and Accountability Measures

To ensure compliance with the settlement, Dollar General is required to promptly abate any future violations related to blocked exits, access to fire extinguishers and electrical panels, and improper material storage. These hazards must generally be corrected within 48 hours, with proof of correction submitted to OSHA. Failure to correct these hazards will result in significant monetary assessments, starting at $100,000 per day of violation, up to a maximum of $500,000. This strict enforcement mechanism underscores the seriousness of the agreement and holds Dollar General accountable for maintaining safe conditions in its stores.

To further enhance safety compliance, Dollar General has retained a third-party consultant to identify hazards and analyze enterprise-wide contributing factors. Additionally, a third-party auditor will perform unannounced compliance audits annually at all covered stores. These audits will assess key safety aspects such as egress, access to fire extinguishers and electrical panels, electrical hazards, and storage conditions.

The company has also established a new Safety Operations Center dedicated to detecting store hazards and supporting safety performance. This center will play a pivotal role in monitoring safety conditions and ensuring that corrective actions are taken promptly.

Recognizing the importance of anonymous reporting, Dollar General has maintained a hotline for employees and the public to report safety concerns without fear of retaliation. This hotline is an essential tool for identifying and addressing safety issues that might otherwise go unreported.

As part of the settlement, Dollar General is required to monitor the outcomes of these safety initiatives and provide quarterly reports to OSHA. These reports will detail the progress made in improving safety conditions and highlight any ongoing challenges. This transparency is vital for maintaining accountability and ensuring continuous improvement in workplace safety.

Resolution of Inspections

The settlement resolves existing contested and open federal OSHA inspections involving alleged violations such as blocked emergency exits, blocked electrical panels, blocked fire extinguishers, and unsafe storage conditions. By addressing these violations comprehensively, Dollar General aims to set a new standard for safety in the retail industry.

The Department of Labor’s settlement with Dollar General marks a pivotal step in ensuring safer workplaces and fostering a culture of safety within the retail sector. Through these comprehensive measures, Dollar General is poised to significantly enhance its compliance with safety regulations and protect the well-being of its employees nationwide.
